Food Vendors Terms & Conditions

 

 

Please read carefully, and if you can comply with these Terms & Conditions,

we welcome you to complete the online

1.     Food Product & Service

 

1.1.   Only vegetarian and vegan product is permitted in the ConFest Market

 

1.2.   All foods containing nuts, soy products, gluten or any other allergens must be clearly marked on menu boards.

 

1.3.   Down To Earth has a strict No Disposables policy. No disposable crockery/cutlery, packaging, containers or utensils are to be used in the serving of food or drink from market stalls. Tins, paper serviettes and bags, drinks and juices from plastic, styrene or paper containers are not permitted, nor is plastic cutlery.  Re-useable tough plastic glasses may be used for cold beverages.

 

1.4.   Food vendors must have their own mark on their cups and crockery.  We suggest offering a coin refund on the return of cups and crockery.

 

 

2.     Insurance

 

2.1.   All ConFest Market vendors must have Public & Product Liability Insurance of $20 Million as well as any other Insurance consider appropriate to cover Acts of God, to ensure Down To Earth and its Officers are fully indemnified against any loss incurred by you while you are on the ConFest Site.

 

2.2.   ConFest Market vendors must upload a Certificate of Currency covering the ConFest period with their online Application Form.

 

 

3.     FSS Certificates

 

The NSW Food Authority require all vendors that handle food for sale to have at all times of trade, an onsite attendant who holds a ‘NSW Food Safety Supervisors Certificate’ obtained through a relevant Registered Training Organisation. FSS certificates expire 5 years from the date of issue. For more information please go to; https://www.foodauthority.nsw.gov.au/

 

3.1.   Food vendors must upload with their application form, a current NSW Food Safety Supervisors Certificate for each person who will be acting in a supervisory capacity on their stall at any given time.

 

3.2.   Food vendors must have a FSS certificate holder working in their stall at all times of trade during.

 

 

4.     Council Registration

 

4.1.   ConFest Market falls under the jurisdiction of the Edward River Council, who require ConFest Food vendors to complete the Council food registration form and submit it with the ConFest Market Food Vendor Application Form.  The ConFest Market Committee will then lodge the Council food registration form on vendors behalf. You can download the form here;

 

 

5.     Power

 

The ConFest Market Committee is committed to a 5 year transition to low noise and low emissions power technology in the Market.  We therefore ask vendors to bear this in mind in the generators they consider going forward. 

 

5.1.   Food vendors who require power must provide their own noise reduced generators.  

 

5.2.   Generators must be noise insulated as much as possible. 

 

5.3.   Generators must be turned off when not trading.

 

5.4.   Naked flames are only permitted in food vendor cookers while trading, designated cooking circles and in the fire twirling circle.  Vendors are not permitted to otherwise use personal cookers, nor use candles or tea lights etc.

 

5.5.   All gas and fuel storage must be safe and supplied by stallholder. 

 

 

 

6.     Sullage

 

6.1.   Water will be provided to each food stall by tap, food vendors will need to have own hose to connect into the water system.

 

6.2.   Sullage is for liquid only, no food scraps are to go down the pipes. Instead all food scraps, peels etc must go down the designated compost pit.

 

 

7.     Health & Safety

 

7.1.   All measures must be taken to comply with the requirements of SafeWork NSW to protect the health, safety and welfare of workers and visitors at the event. refer; https://www.safework.nsw.gov.au/  .

 

7.2.   All vendors must comply with NSW Food (general) Regulations, see; https://www.foodauthority.nsw.gov.au/

 

7.3.   Kitchens must be built and operated according to NSW Food Authority Guidelines For Food Businesses at Temporary Events.  All other guidelines in this document must also be adhered to.  Download a copy of the guidelines here;  http://www.foodauthority.nsw.gov.au/_Documents/industry_pdf/temp_events_guideline.pdf 

 

7.4.   The Edward River Council Food Safety Officers are the total authority on Food Safety.  A ConFest Market Committee member will accompany the Council Officers on their inspections, and will hasten the removal of any food vendor found in breach of Food Safety regulations.

 

7.5.   The ConFest Market operates in total compliance to the Down To Earth Cooperative Fire Safety Team, and vendors must follow any direction given by them on fire and general safety.  Failure to do so will result in being evicted from the ConFest.

 

7.6.   Food vendors must have at hand a prescribed fire blanket, cooking specific fire extinguisher(s), and other kitchen hazard prevention safety equipment.

 

 

8.     Site Access

 

8.1.   In addition to the market stall fee detailed in the ConFest Market Food Vendor Application form linked, vendors are required to purchase ConFest general admission tickets for all workers and accompanying persons they are bring on site. General ticketing terms and conditions apply.

 

Bump-In

 

8.2.   ConFest Market vendors are expected to be open for trade by midday on Wednesday 5 April when gates open to the general public.

 

8.3.   Food vendors are permitted to bump-in onsite 2-days ahead of gates opening to public. Therefore food vendors will have ConFest Front Gate clearance from midday Monday 3 April, strictly between 9am and 5pm.

 

8.4.   Vendors will need to be onsite by no later than dusk on Tuesday 4 April.

 

 

Bump-Out

 

8.5.   Vendors will not be able to disassemble marquees or other stall structures until am on Tuesday 11 April

 

8.6.   The earliest vendor vehicles can leave the site upon pack-down is at 9am on Tuesday 11 April, and all market vendors must be off site by no later than dusk on this day.

 

Vehicle Pass

 

8.7.   Food vendors are only permitted pass-outs to replenish supplies in cars that have been provided a Vehicle Pass, and which are displayed on dashboards. Vehicle Passes are applied for in the online ConFest Market Application form.

 

Deliveries & Hire Transport

 

8.8.   Email notification must be provided at least 1-day in advance of any marquee hire delivery or other transport hire company vehicles requiring access to the site for vendors’ set-up and/or pack down of a stall.  Email market@dte.org.au

 

Pre-Allocated Stall Space

 

8.9.       Market vendor stall space is pre-allocated within our market plan layout.  Accordingly, stalls will have a measured out and sign posted location prior to vendors arriving.  Vendors will not be permitted to change their location in the market plan.  As sharing generators, refrigerators and other resources is encouraged, upon final selection of vendors, we will call for requests from vendors who wish to be allocated next to a specific vendor(s).

 

9.      Rubbish Removal

 

9.1.   The ConFest Market has a strict ‘Leave No Trace’ policy.  Food vendors are responsible for the removal of all their rubbish from the ConFest site.  A skip hire option is available in the online ConFest Market Food Vendor Application form. 

 

10.  Stall Fees

 

Stall fees are all inclusive of a minimum 6 days trading, as per bump-in and bump-out times specified in the ConFest Market Terms & Conditions.  

The following prices are stall fees only.  Vendors are required to purchase ConFest general admission tickets for all workers and accompanying persons they are bring on site. Stall fees will be invoiced to successful applicants, with details of ticket purchase to follow. 

Commercial Food:    $1,000 for initial 6 metre stall frontage… plus $500 for each extra 3 metre frontage.  

Not-For-Profits:        $300 for initial 6 metre stall frontage… plus $150 for each extra 3 metre frontage.  

Rubbish Skip Hire:    $300 for a 3 cubic metre skip.

11.  Application

 

11.1.    Application to be a food vendor at the ConFest Market is strictly via the online ConFest Market Food Vendor Application form at market.dte.org.au.  No other form of application will be accepted.

 

11.2.    The online ConFest Market Food Vendor Application form must be completed fully to be considered. 

 

11.3.    Any food vendors who fail to abide by these Terms & Conditions, will be evicted from ConFest immediately, and applications for stalls at future ConFest gatherings will not be considered.

 

11.4.    Applications close 5pm Friday 25 November.  All applicants will be advised of the result of their application by Monday 18 December 2022

 

 

12.  Selection Criteria

 

There will be a maximum of 15 vegetarian and vegan food stalls at the ConFest Market. 

 

ConFest Market Food Vendors are selected by the ConFest Market Committee members.  Selection is made on various criteria including but not limited to; full completion of this online ConFest Market Food Vendor Application form, compliance with the ConFest Market Terms & Conditions (available for download at market/dte.org.au), the mix and variety of food stalls, past participation and performance at ConFest Market, and an alignment with the spirit of ConFest.

 

13.  Complaints Handling

13.1 Vendors that have any issues or feel they have been treated unfairly can write to  market@dte.org.au.  All such correspondence will be reviewed by the ConFest Market Committee, and a written response provided within 31-days.
